PLEASE READ THIS DOCUMENT CAREFULLY! IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.

These terms and conditions apply to your purchase of products sold in the United States and Canada by Geneva Lab Corporation (Geneva Lab). By Placing an order on the www.genevalab.com website or by telephone to a sales representative of Geneva Lab Corporation, you accept that you have read, understood and agree to be bound to the terms and conditions set out in this document.

U.S. and Canada SALES ONLY
Geneva Lab only sells and ships products within the continental United States (excluding Puerto Rico and U.S. possessions and territories) and Canada. No shipments can be made to APO or FPO addresses, United States territories, or addresses outside the United States and Canada.

RETURN & REFUND POLICY (U.S. and Canada Only)
Geneva Lab offers a 30-day return policy, if for any reason our product would not meet our customer’s expectations. We take great pride in ensuring your satisfaction. Should you for any reason wish to return a product within 30-days from the date of your invoice or receipt, please follow the procedure set out below.

How to Return
To return products, you must first contact Geneva Lab Corporation customer service:

...and receive a Credit Return Authorization Number within the 30-day return policy period, applicable to the product you want to return. You must obtain a Credit Return Authorization Number in order to return the product.

You must ship the products to Geneva Lab Corporation within five (5) days of the date that Geneva Lab Corporation issues the Credit Return Authorization Number. You must:

  • Ship back all products you are seeking to return to Geneva Lab Corporation.
  • Return the products in their original packaging, in as-new condition along with any media, documentation, and all accessories and other items that were included in the original shipment.
  • Ship the product(s) at your expense, and insure the shipment or accept the risk of loss or damage during shipment. We also recommend that you use a forwarder that offers shipment tracking, so that missing shipments can be tracked down. Please note that you are responsible for all return shipments until Geneva Lab Corporation has signed for the receipt of the shipment.

Upon receipt of the complete returned purchase and inspection to confirm that the product has been returned in as-new condition, Geneva Lab Corporation will issue a credit or a refund of the purchase price paid, less shipping and handling charges. Refunds will be credited only to the original purchasing credit card. You will receive an email credit message when your return has been processed. Please note that refunds and credits may take up to 2 weeks to appear on credit card statements due to necessary processing time. No credits can be issued, if you have not first received a Credit Return Authorization Number.

Shipping Damage on Arrival
If you receive a delivery in a shipment box that is visibly significantly damaged, we suggest that you do not accept the delivery. Please request that the courier that delivered the package, return it to the Sender (Geneva Lab Corporation). Please note that this refers to significant damages to the shipping box, which could cause the content to be damaged. Small damages, such as dirt, or scratches to the outer shipping box, may occur during transport, without harming the inside content. Geneva Lab will not ship any boxes out of its warehouse, which have significant external damages.

After you refused the delivery of a damaged shipment, please call Geneva Lab Customer Service at 1-877-GENEVA9 (1-877-436-3829) within 5 days. When the damaged shipment arrives in return to Geneva Lab, our Technical Support Team will inspect the content and determine if it has been damaged. If not, we will re-pack the goods and return it to you promptly at Geneva Lab’s expense. If the content of the damaged shipping box has been damaged, Geneva Lab will replace it with the same product and ship it to you free of charge.

Dead On Arrival Product: hardware failure Out of the Box
A product is considered Dead On Arrival if it shows symptoms of a hardware failure, preventing it to operate, upon its first use out of the box. If you believe that your product is Dead On Arrival, please call Geneva Lab Customer Service at 1-877-GENEVA9 (1-877-436-3829) within 30 calendar days of the invoice or receipt date, in order to obtain a Return Merchandize Authorization Number, for you to include with your return. Please return the merchandize in their original or equivalent packaging along with any media, documentation, and all accessories and other items that were included in the original shipment. Shipping will be arranged by, and paid by, Geneva Lab. Geneva Lab will determine whether the product is Dead On Arrival and the same product that you ordered will be shipped to you at Geneva Lab’s expense. If the product is not reported Dead On Arrival within 30 calendar days of invoice or receipt, Geneva Lab's standard product Limited Warranty will apply if the product is deemed by Geneva Lab not to be Dead On Arrival, Geneva Lab's standard product warranty will apply. Geneva Lab reserves the right to test returned Dead On Arrival product. If the condition of the product is misrepresented by the customer, Geneva Lab may impose a USD250 handling fee, plus the shipping costs incurred by Geneva Lab.

DEFECTIVE ITEMS
If you discover what you believe is a product defect, please contact the Geneva Customer Support Team at 1-877-GENEVA9 (1-877-436-3829). Such a defect, if any, is covered under the terms of your product's Limited Warranty. Please refer to the Limited Warranty card (or the Limited Warranty section below for specific information about Geneva Lab's product warranties) and other supporting documentation that came with your product.

PAYMENT METHODS
Credit Card
You may pay by credit card no matter which ordering method you use (Internet or phone). At the time your order is placed, Geneva Lab obtains a pre-approval from the credit card company for the amount of the order. Credit card billing occurs when your order ships.Geneva Lab accepts Visa, MasterCard, American Express, and Discover cards.

PLEASE NOTE:

  • We are unable to accept credit cards issued by banks outside of the United States and Canada.
  • Debit cards and check cards have daily spending limits that may substantially delay the processing of your order.

Card Verification Value Numbers (CVV)
Geneva Lab requires the Card Verification Value Number for your credit card, for any telephone or online purchases. The Card Verification Value Number (or commonly known as credit card security code) is an individual three- or four-digit number specific to your credit card that may be printed on the face of your card above the embossed account number (if American Express), or on the back of your card, on the signature panel (if Visa, MasterCard or Discover). Asking for and confirming your credit card's Card Verification Value Number helps validate that you - and only you - are in the possession of your credit card and protects you from unauthorized use of your account.

Cashier's Check or Money Order
Geneva Lab accepts cashier's checks and money orders as valid forms of payment. Personal or business checks are not accepted. If you wish to pay by cashier's check or money order on our web-store, simply select “pay by check” under payment method while checking out. Send your check to the address below within 10 days. You may also order by phone at 1-877-GENEVA9 (1-877-436-3829) and request to pay with Cashier’s Check or Money Order. The cashier's check or money order must be payable to Geneva Lab Corporation, and include your order confirmation number and/or a copy of your order. Please mail your payment to:

Geneva Lab must receive your payment within 10 calendar days or your order will be canceled. Please allow 1 business day for order processing after Geneva Lab receives your payment.

PROOF OF PURCHASE
Geneva Lab will send you a confirmation of your order via email if you have included an email address with your order.
At the time of shipment, Geneva Lab will charge the credit card and issue a Receipt for the payment. If payment is made by Cashier’s Check, Money Order or Wire Transfer, Geneva Lab will issue a Receipt when the payment has been credited to the bank account of Geneva Lab. If you have included an email address with your order, we will email you the Receipt or it will be sent by regular mail. Please save this Receipt as it also serves as validation for the Limited Warranty period offered with the purchase of Geneva Lab’s products. For further details, see the section “Limited Warranty” below or consult the Limited Warrant card enclosed to your Geneva Lab product.

SALES TAX
Purchases from Geneva Lab will not include sales tax except for residents of South Dakota.

For residents of South Dakota only:
The sales tax will be calculated based on the sales tax rate in effect at the time your order is placed, and it will be added to the total dollar order value. If you phone in your order from South Dakota, the Geneva Lab sales representative will provide an estimated dollar total of your order including tax and any applicable shipping charges at the time you place your order. If the sales tax rate in South Dakota changes before the product is shipped, the rate in effect at the time your order was received in our system will apply. The Receipt that Geneva Lab email or regular mail to you, will include any applicable sales tax.

SHIPPING OPTIONS
U.S. only (for Canada, see below)
Geneva Lab offers 3 convenient shipping options for destination within the Continental U.S.:

  • Standard Shipping (UPS Ground): This option is available on all orders over USD100 for no additional charge. Products shipped to addresses in the continental U.S. via standard service are normally delivered within five business days after shipment (Hawaii and Alaska may take longer).
  • 2-Day Shipping to locations within the U.S (UPS Second Day Air): For an additional charge, we offer this expedited shipping option. Products shipped via two-day service prior to 1:00 p.m. CST, are normally delivered two business days after shipment.
  • Overnight Delivery (UPS Next Day Air Saver): For an additional charge, we offer this expedited shipping option on most of our products shipped within Continental U.S. Products shipped prior to 1:00 p.m. CST, via overnight service are normally delivered by 3:00 p.m. local time one business day after shipment. Overnight delivery is not available for orders shipping to Alaska, and Hawaii.

Signature is required for delivery: Most of our shipments contain valuable equipment. If you will not be at the shipping address to accept delivery of your product, consider shipping the item to an address where someone you trust will be available to sign for your package. Please note that we are not able to adjust the shipping address once a package has left Geneva Lab's warehouse. Title and risk of loss to all products will pass to you on delivery.

Undeliverable Packages: Occasionally packages are returned to us as undeliverable. When the carrier returns an undeliverable package to us, please contact us to make arrangements for reshipment.

Failed Delivery Attempts: Most of our carriers make three attempts to deliver a package. After three delivery attempts, the package will be returned to us.

Canada only (U.S., see above)
Geneva Lab offers 2 convenient shipping options for destination in Canada:

  • Standard Shipping (UPS Standard): For a Canadian shipping surcharge of USD25, this option is available on all orders over USD100. Products shipped to addresses in the Canada via Standard Shipping are normally delivered within 5-14 business days after shipment, depending on location. Please note that during high season, custom clearance in Canada may be slow and your shipment could be delayed. For this reason, UPS will not offer a guaranteed delivery date for this service.
  • Next Day Delivery to locations within Canada (UPS Worldwide Express): For an additional charge, we offer this expedited shipping option. Products shipped via UPS Worldwide Express service prior to 1:00 p.m. CST, are normally delivered end of business, the next day.

Custom clearance and Canadian Custom duty and taxes:
All prices we quote, including shipping costs, for deliveries to Canada are exclusive of any Canadian custom and excise duties and any National or Provincial sales taxes. Please note that most of our products do not origin from the U.S. and applicable custom duties may apply. You may also have to pay Canadian Goods and Service Tax (GST), as well as, applicable Canadian Provincial Sales Tax (PST) or Quebec Sales Tax (QST). In Canadian provinces with a Harmonized Sales Tax (New Brunswick, Nova Scotia, and Newfoundland and Labrador), you'll be charged a flat 15 percent, rather than separate ST and PST. UPS will calculate any applicable duties and taxes and collect them from you at the time of delivery, together with their customs brokerage fee. PROCESSING
The estimated shipment date for your order is based on product availability, payment processing time, and warehouse processing time and does not include transit time. Payment processing will not begin until we receive all the information we need and full payment or a full authorization, in the case of credit card.

Orders placed on the weekend or on a holiday will begin payment processing the next business day.

Orders for in-stock items that are eligible for same-day shipping must be received before 1:00 p.m. CST, pending payment processing. Orders placed on the weekend or on a holiday will begin payment processing the next business day. Unanticipated changes in supply can affect product availability. Please confirm the estimated shipping lead-time at the "Review Your Order" page for the most current availability information.

Business days are Monday through Friday, excluding federal holidays.

SHIPMENT CONFIRMATION
Geneva Lab will confirm shipments to you on the same day as they are shipped from our warehouse. This confirmation will include the name of courier service we have used for the shipment and Tracking number that you can use to track you shipment by entering the website of the courier or through a link from www.genevalab.com/tracking.html.

PRICES
Geneva Lab mainly offers products that are being exclusively designed, manufactured and sold through its web store. The pricing policy of Geneva Lab is to offer very good “value for money” and to keep our list prices very competitive. Geneva Lab therefore does not negotiate or agree to any special discounts, other than price reductions that may be published in our web store from time to time. This may occur if Geneva Lab has succeeded in reducing the manufacturing cost of a particular product.

Your total order price will include the price of the product (on the day of ordering) plus any applicable shipping charges. For residents in South Dakota, sales tax will also be added to the total order value. Geneva Lab reserves the right to change prices for products displayed at the Geneva Lab web store at any time.

PRODUCT AVAILABILITY

Regular orders
Estimated order lead time (or displayed as “ships within xx days” on our website) is the length of time it will take us to ensure that we have the product in stock, validate your credit card, package and ship your order. Shipping time is the length of time it will take for the package to travel from our warehouse to your shipping address.
Geneva Lab makes every effort to ship your product according to the estimated lead times provided at the time of checkout. The estimated lead times are in business days (Monday through Friday) excluding Federal Reserve holidays. Lead times will begin the following business day for orders placed and credit cleared after 1 p.m. CST. Lead times quoted on the checkout page are for orders that are partially shipped - meaning items ship as soon as they are available. If you have requested a complete shipment, we will not make any partial shipments.

Although every effort is made to ship your order according to the lead-time provided, shipping dates may change due to changes in supply. If the lead-time changes, Geneva Lab will contact you via email or by telephone and provide a revised shipping estimate. For orders that can not ship within 2 weeks after the given order lead time, Geneva Lab will accept full cancellation without billing your credit card or completely return any prepayment made for the cancelled merchandize. Your cancellation must be made in writing and sent via email or registered mail, and received by us prior to the shipment being dispatch from our warehouse.

Geneva Lab constantly develops new products, as technologies evolve and for this reason, Geneva Lab reserves the right to discontinue current products without notice.

Pre-orders
Geneva Lab is a relatively new entrant to the North American market and therefore has limited sales history that can for the base for forecasting future sales. We are making our outmost efforts to try and forecast the demand for our different models and colors in order to have them in stock at any given time, but given high popularity of some products, we may not always be able to achieve this. If Geneva Lab expects that the shipping lead-time for a product will exceed 2 weeks, Geneva Lab will not accept regular orders for this product. Instead we will offer a Pre-order service, where you will get a priority of delivery when the product comes into stock. For pre-orders, we will take all order details from you as with a regular order, including the selected payment option. When the product arrive our warehouse, we will first contact you by email or telephone to get your confirmation that you want to proceed with the shipment. We will not charge any credit cards and return any pre-payments in full, if you select not to proceed with the order.

PRODUCT WARRANTY
All Geneva-branded hardware products purchased from Geneva Lab Corporation in the U.S. or Canada comes with a 1-year, limited warranty. OTHER TERMS AND CONDITIONS
"These terms and conditions and your purchase of all products shall be governed and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Each of us hereby designate the state or federal courts of Franklin County, Ohio as the courts of proper jurisdiction and exclusive venue for any actions or proceedings relating to these terms and conditions or your purchase of any products; hereby irrevocably consent to such designation, jurisdiction, and venue; and hereby waive any objections or defenses relating to jurisdiction or venue with respect to any action or proceeding initiated in such courts."
